The Chilean constitutional process is moving beyond another stage

The 14 chapters of the draft and provisional decisions were made available to the recently elected Constitutional Council, which will take over on June 7 to prepare the final text.

According to the chair of the commission, Veronica Ondoraga, it is a document of good quality that reflects “the pluralism that exists in Chilean society”.

It is not a constitution that any of us would dream of, the expert said, but a constitution in which all Chileans feel they can live together and have their own constitution.

Anduraga called on the constitutional advisors, who will have five months to complete their mission, to work in the same spirit and sense of commitment.

One of the highlights of the project was the proclamation of the country as a social and democratic state of law, in which fundamental freedoms are recognized and the progressive development of guarantees for all its inhabitants is promoted.

Human dignity is inviolable and the basis of law and justice, as defined by the Magna Carta proposal, adding that people are born free and equal in dignity and that respecting and ensuring them is the first duty of the political community.

If the text is maintained, Chile remains organized as a republic with a presidential system, with division of powers, and the legislature retains a bicameral composition.

Although indigenous peoples were recognized, the principle of multinationalism, which was one of the strongest demands of indigenous communities, was rejected.

The next stage will be in the hands of the Constitutional Council, consisting of 51 members, in which the far-right Republican Party and the right-wing Chilean Famos coalition will have a qualified majority and veto power.

Another controversial point in this body is that there is only one representative elected by the indigenous peoples, which does not reflect the ethnic composition of the country, as they represent 12 percent of the total population.

The obtained document will be submitted to a referendum on December 17, and if rejected, its validity will be extended for an indefinite period of the constitution imposed by the military dictatorship in 1980, where the rules of the neoliberal order are.
