Reactivation of criminal proceedings against the former President of Panama

In opinion, the High Court of Justice annulled what had been done in January of this year, when the First High Court of Justice ordered Judge Baloisa Marquinez to annul what had been done in the first hearing in January of this year.

On that occasion, the attorney ordered the interruption of proceedings against the brothers David and Daniel O’Shea and the former president.

In the O’Shea case, the judge made this decision because they were not notified of the hearing, while Martinelli at the time maintained electoral criminal jurisdiction.

The current ruling states that Judge Marquenez did not violate the fundamental rights of the defendants and that she acted in accordance with the law.

With this decision, CSJ allows Marquinez to continue the process and make its decision on whether or not to summon the accused to trial.

The hearing against those involved in the purchase of the Editora Panamá América SA group with public funds last January was suspended at the request of the Public Prosecutor’s Office.

This decision responded to the fact that the former president’s defense filed a notification from the Electoral Tribunal (TE) confirming that the RM, headed by Martinelli, was in an internal election and therefore protected by the electoral judiciary.

The investigation consists of 164 volumes and began in 2017, when the Public Prosecution Office learned of a crime against the economic system for the illegal purchase of a media group.

Martinelli faces other charges in various corruption cases, including bribery from the Brazilian construction company Odebrecht whose trial is expected to take place next Monday; It also maintains the precautionary measure to prevent leaving the country.
