Court rejects dispute over counseling INE

The First Chamber of the Supreme Council of the Press approved the validity of the decree issuing a call for popular consultation, which must be organized by the National Institute of Statistics, as published in the Official Gazette of the Union in 2020.

As is reported, the National Elections Institute has challenged the decree considering it a violation of its constitutional and budgetary independence, as it asserted that by not providing the necessary resources for this practice, the procedure prevents the institute from performing its constitutional functions. However, the Supreme Council of Journalists has decided that creating or defining the economic resources by which the National Elections Institute must organize, publish, develop, calculate and publicize the results of the popular consultation is not the prerogative of legislators in the Federal Congress.

The exercise – protected by the provisions of the popular consultation and de-delegation in the Political Constitution of the United Mexican States – shall be carried out by the Institute in accordance with “the budget availability for 2019 and subsequent fiscal years”.
